June 27—The Centers for Medicare & Medicaid Services (CMS) has released a final rule addressing eligibility exemptions and minimum essential coverage provisions as they relate to health insurance marketplaces (formerly known as exchanges). 

The Affordable Care Act requires individuals to maintain minimum essential health coverage or make a payment on their tax return (otherwise known as an individual shared responsibility payment). The final rule provides standards and processes that the marketplaces should follow when determining eligibility for, and granting certifications of exemption from, the individual shared responsibility payment. 

The final rule also provides standards for determining whether a particular type of health insurance coverage constitutes minimum essential coverage and designates certain types of existing health coverage as minimum essential coverage. 

The regulations covered in the final rule become effective August 26, 2013.
