Amicus Brief of The Healthcare Financial Management Association on Disclosure of ‘Negotiated Charges’

HFMA filed an amicus brief on the American Hospital Association’s appeal to overturn a Department of Health and Human Services rule requiring hospitals to disclose their privately negotiated rates with insurers. HFMA provided context that the financial information that is most meaningful to patients is the amount that is their out of pocket payment and that the terms of ‘charges’ and ‘prices’ are distinct and should not be used interchangeably.
